Overview

The sharing of information about COVID-19 transmission is critical to containing the COVID-19 pandemic. But although HIPAA already has some provisions for sharing PHI in emergencies and disasters in the Privacy Rule, which will be explained, DHHS has relaxed some other rules and stated that it will not enforce yet others to facilitate the effective prevention and treatment of the disease. But the majority of HIPAA's Security and Privacy Rules remain in effect and are being aggressively enforced by DHHS. The webinar will cover the existing rules applying to the use and disclosure of COVID-19 PHI, the limited HIPAA waivers and non-enforcement areas, the guidance to public health entities and first responders as to the collection and sharing of COVID-19 PHI, and the waiver of enforcement for telehealth which has grown exponentially during the pandemic. The webinar will conclude with how the virus and DHHS's waivers affect patient rights to a notice of privacy practices, to access, to request restriction, and to disclosures to family members, the Press, Public Health Authorities, and others.

In addition, the webinar will cover current enforcement measures, such as the DHHS initiative to ensure covered entities and the increased threat of ransomware brought about by the pandemic.

The COVID-19 Pandemic has and will continue to impact HIPAA compliance. Although the Department of Health and Human Services has relaxed HIPAA compliance in some areas, to facilitate dealing with the pandemic, the bulk of HIPAA compliance issues remain. And DHHS continues to impose civil money penalties and settlements in lieu thereof during the pandemic. DHHS has, for example, continued its initiative to sanction covered entities that fail to afford individuals their right of access to PHI about them.

In addition, ransomware attacks have continued and even increased during the pandemic. The health sector is the primary target of criminals using ransomware to extort money. But paying the ransom can subject covered entities to federal criminal charges for funding a terrorist group. Covered entities need to know how to protect against such attacks and how to respond if one occurs.And the increased use of telemedicine for medical care that is social distancing raises HIPAA issues.
